TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of kaga88.com (the “Site”) and the demonstration versions of KA games made available on it (together, the “Service”). The Site is operated by KA Systems Global, Ltd. (“KA”, “we”). By using the Service you confirm that you have read, understood and agree to these Terms. If you do not agree, do not use the Service.

The Service is intended for gaming-industry professionals evaluating KA products. You must be at least 18 years old — or older, where the law of your country sets a higher age for access to gambling-related content — and you confirm that you meet that requirement.

Your personal information is handled under our Privacy Policy, which forms part of these Terms.

Every game on the Site is a demonstration version played with virtual credits. Those credits have no monetary value and cannot be exchanged, transferred or redeemed for money, goods or anything of value.

KA is a business-to-business games supplier and does not operate gambling services. Through the Site, KA accepts no deposits, pays no withdrawals, accepts no bets or stakes of monetary value, and offers no opportunity to win money or any prize. Nothing on the Site is an offer or invitation to gamble.

KA games are licensed to third-party operators who hold the relevant gambling licences. Any real-money play takes place on those operators’ services, under their terms and their regulatory authorisation — not here.

Subject to these Terms, KA grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access the Site and play the demonstration games for the purpose of evaluating KA products. No other use is permitted. This licence ends immediately if you breach these Terms, and is not granted where access to the Service would be unlawful under the law that applies to you.

Use the Service lawfully and in good faith. You agree not to:

• use the Service if you are under 18, or under the higher age set by the law of your country;
• copy, scrape, mirror, frame or systematically extract any part of the Site, its game list or its content;
• decompile, disassemble or reverse engineer any game or other software made available through the Service, or attempt to derive its source code or mathematical model;
• interfere with, probe or overload the Service, its servers or its networks, or circumvent any security or access control;
• use bots, scripts or other automation against the Service, other than well-behaved search-engine crawlers;
• upload or transmit malware or any code intended to harm the Service or its users;
• misrepresent the Service, the demonstration games, or your relationship with KA;
• submit false or misleading information through any form on the Site, or use it to send unsolicited commercial messages;
• publish, through any chat or messaging feature a demonstration game may offer, material that is unlawful, obscene, hateful, defamatory or that infringes the rights of others.

Where a demonstration game offers a chat or messaging feature, anything you submit through it is public rather than private, may be monitored or removed at KA’s discretion, and remains your responsibility.

The Service and everything in it — software, game mathematics, designs, graphics, text, images, audio, video, trade marks, and their selection and arrangement — belong to KA and its licensors and are protected by copyright, trade mark and other intellectual-property laws worldwide. Lock 2 Spin and Fusion Reels are trade marks of KA. Using the Service grants you no ownership of anything and no right to use KA’s names, logos or trade marks without our prior written permission. Third-party names and marks shown on the Site belong to their respective owners and appear for identification only.

The Site links to sites operated by others, including partners, event organisers and social networks. KA does not control those sites, does not endorse them, and is not responsible for their content, their availability, or how they handle your information. Following such a link is at your own risk and subject to that site’s own terms.

KA may change, suspend or discontinue any part of the Service — including which games are available for demonstration — at any time, without notice or liability. Game information published on the Site, including titles, features, RTP levels, performance figures and availability, is indicative, may change, and may differ between markets and operators; it does not form part of any contract.

We may revise these Terms at any time. Revised Terms take effect when posted on this page with an updated date. Continuing to use the Service after that means you accept them; if you do not, stop using the Service.

The Service is provided “as is” and “as available”, and your use of it is at your sole risk. To the fullest extent permitted by law, KA and its officers, directors, employees and agents disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Service is free of harmful components. Demonstration results and published performance figures are illustrative and do not guarantee how a KA game behaves once deployed by a licensed operator.

To the fullest extent permitted by law, KA will not be liable for any indirect, incidental, special, punitive or consequential damages — including lost profits, lost business or lost data — arising from your use of, or inability to use, the Service, under any legal theory, even if advised of the possibility of such damages.

You agree to indemnify and hold harmless KA and its directors, officers, employees, agents and contractors from any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

These Terms, and any dispute arising from them or from the Service, are governed by the laws of the Republic of China, without regard to conflict-of-law principles. Any claim shall be brought exclusively before the courts of Taipei, and you consent to their jurisdiction and venue. Any cause of action must be commenced within one (1) year of accruing, or it is permanently barred.

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force. KA’s failure to enforce a provision is not a waiver of it. You may not assign these Terms; KA may assign them freely. These Terms, together with the Privacy Policy, are the entire agreement between you and KA regarding the Service. KA is not liable for any failure or delay caused by events beyond its reasonable control.
